Discussion Megathread: Supreme Court decisions week of 6/12/17

Posted: 12 Jun 2017 08:08 AM PDT

Introduction

Welcome to /r/politics' discussion thread for Supreme Court decisions! The Supreme Court traditionally releases a number of decisions on Mondays, with many high profile cases (eg. Obergefell v. Hodges; NFIB v. Sebelius) being decided in June. We aren't sure what cases will come out this week, but a couple significant ones have not been decided yet (Sessions v. Binderup, Peruta v. California, Masterpiece Cakeshop v. Colorado_). This thread is intended for users to discuss newly issued opinions, as well as opinions from earlier this term. As a reminder, please be civil and respect our comment rules.

Opinions, notable Orders, and Grant of Certiorari

  • Order List

  • Sessions v. Morales-Santana (holding that the 8 USC §1401's differential treatment of children born of a single US citizen on the basis of gender violates the 5th Amendment). US law confers citizenship to children of even a single US citizen, but the standard for obtaining citizenship from an unwed US father are higher than the standard for unwed US mothers (rather, §1409 creates an exception for unwed mothers). The Court held that this differential treatment violates the 5th Amendment's equal protection clause, but declined to extend the deferential standard for unwed mothers to unwed fathers as well.

  • Virginia v. LeBlanc (holding that the state trial court did not improperly apply the Graham v. Florida standard, which held unconstitutional sentencing of juvenile offenders to life without parole for non-homicide offenses).

  • Henson v. Santander (holding that debt buyers are not "debt collectors" under the Fair Debt Collection Practices Act). This is Justice Gorsuch's first opinion.
